As of now it is legal for companies, universities, etc. in Germany to discriminate against you for something they found online and they are very strict about it. As soon as possible employers find anything suspicious/concerning there will be further research and consequences. These institutions may be harsh with their judgement, but rightly. Each German school conducts annual Assemblies that are mandatory for students with parents being invited to participate in, all about the internet, social media and how to use the both wisely and carefully. I do not think Germany should be making a law forbidding companies to discriminate for your social media, since as a German citizen, you’d have either participated in one of those assemblies or thoroughly informed and therefore warned of the consequences of controversial posts on social media. Besides, if you really want to get into a good university or get employed for a good company, do you really want them to see images of you that would throw others off or give the company/university a bad name for taking you, considering the image you are captured in? In my opinion, social media can have a powerful effect, either positive or negative and you must control which. If you chose to portray yourself in an obscene way on your social media, you may do so, since you have the freedom of speech, yet the institution should also have the right to use social media as factor when choosing students or employees. If brought to court, I think the one accused of discrimination (Defendant) should be tested on whether or not the discriminated (Prosecution) was stating a clear and present danger, which is the only exception for freedom of speech, or was disturbing (if available) learning or working environment materially and substantially. In my opinion, one, not only institutions like schools or companies, should be allowed to make judgement based on social media, since it is an easier way of getting to know someone. And if he/she chooses to publish false information, doesn’t that say something about the person, too?

Reflection

I did a good job on this, but I was still quite dissapointed, since I got a 7 on my last writing assesment, but on this I only got a 6.
